TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing RoadsideLeads.com, submitting any form, purchasing leads, receiving calls, or using any services provided by Roadside Leads (“Roadside Leads,” “we,” “us,” “our”), you agree to be legally bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, do not purchase leads or use our services.

Continued use of the services constitutes ongoing acceptance of the most current version of these Terms.

2. NATURE OF SERVICES — NO GUARANTEES

Roadside Leads is a lead generation and call delivery service only.

We do not:

  • Guarantee conversions, revenue, profit, or job completion

  • Guarantee customer intent beyond service inquiry

  • Guarantee accuracy, timeliness, or exclusivity unless explicitly stated in writing

  • Control customer decisions, responsiveness, or follow-through

All leads are provided “as-is”.

Any examples, call volumes, or performance estimates are illustrative only and not guarantees.

3. SOURCE OF LEADS & DATA DISCLAIMER

Leads, calls, and contact information may be obtained from:

  • Publicly available sources

  • Third-party platforms

  • Advertising networks

  • Inbound call routing systems

Roadside Leads does not guarantee:

  • Accuracy

  • Completeness

  • Reliability

  • Suitability for any specific business purpose

Buyers are solely responsible for evaluating and using leads.

4. DEFINITION OF A “GOOD LEAD”

A “Good Lead” is defined as any inbound call where:

  • The caller requests or inquires about services the buyer offers, or

  • The buyer offers service to the caller, or

  • The buyer misses the call during their scheduled availability

The following are also considered Good Leads:

  • Missed calls

  • Calls answered but not closed

  • Calls where the buyer declines service

  • Calls where pricing is discussed

  • Calls where the buyer fails to answer

Missed calls are always counted as Good Leads.

5. ABANDONED & MISSED CALLS

  • Abandoned calls are counted as 50% of a lead

  • Two (2) abandoned calls equal one (1) full lead

  • Missed calls equal one (1) full lead

  • Buyer is responsible for staffing, availability, and call handling

Failure to answer calls does not invalidate billing.

6. BILLING & PAYMENT OBLIGATIONS

By purchasing leads, you agree to pay for:

  • All Good Leads delivered

  • All missed calls

  • All abandoned calls as defined above

  • All leads delivered during your selected working hours

Billing determinations are made based on:

  • Call recordings

  • Call logs

  • Time stamps

  • Service inquiry content

Roadside Leads’ determination of lead validity is final.

7. NO REFUNDS — ALL SALES FINAL

All lead purchases are final.

We do not offer refunds or exchanges once leads are delivered.

Any exception:

  • Is entirely discretionary

  • Does not create precedent

  • May incur a $50–$100 administrative processing fee

  • Must be approved in writing by Roadside Leads

⚠️ Do not prepay for leads if you do not agree to these Terms.

8. NO AGENCY OR MARKETING ON BUYER’S BEHALF

Roadside Leads does not:

  • Contact customers on your behalf

  • Close jobs

  • Negotiate pricing

  • Schedule services

  • Act as your agent or representative

All actions taken after lead delivery are at the buyer’s sole discretion and risk.

9. CHARGEBACKS & DISPUTES

Chargebacks are treated as serious matters.

We reserve the right to submit:

  • These Terms

  • Call recordings

  • Call logs

  • Time stamps

  • Lead definitions

  • Billing records

Initiating a chargeback may result in:

  • Immediate termination of services

  • Permanent account ban

  • Collection efforts

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Roadside Leads shall not be liable for:

  • Lost profits

  • Lost jobs

  • Missed opportunities

  • Business interruption

  • Indirect or consequential damages

Total liability shall not exceed the amount paid for the disputed leads.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Roadside Leads, its owners, employees, agents, and affiliates from any claims, losses, damages, or liabilities arising from:

  • Use of leads

  • Customer interactions

  • Failure to answer calls

  • Business operations

  • Violation of these Terms

12. GOVERNING LAW

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

13. MODIFICATIONS

Roadside Leads may update these Terms at any time.
Continued use of services constitutes acceptance of updated Terms.

14. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Roadside Leads.

No verbal statements, sales calls, emails, or representations override this document.

FINAL WARNING

If you do not agree with how leads are defined, billed, or counted — do not purchase leads.
